A patent portfolio is a collection of intellectual property objects (utility models, industrial designs, trademarks, etc.) owned by one Rightholder and providing legal protection for its products and a dominant position in the market
The need to form a patent portfolio is determined by the interests of the company, since intellectual property is an important source of sustainable long-term competitive advantage in the market.
Main advantages of the patent portfolio:
- providing protection from unscrupulous competitors and from “patent trolls,” which include organizations involved in monetizing patents by filing lawsuits for their infringement;
- protection from bankruptcy, since the patent portfolio is a valuable asset of the enterprise and contributes to a significant increase in its budget and profit;
- helps attract investors, since the presence of a patent portfolio makes the copyright holder the most attractive among other applicants for investment.
To correctly form a patent portfolio you must:
- conduct patent research;
- identify the key patented subject matter of priority importance;
- identify information that must be kept secret in order to provide it with the maximum level of protection;
- determine a list of additional objects related to the key object, which are a tool for increasing the value and sustainability of the patent portfolio;
- file national patent applications in the Russian Federation;
- submit an application to the international patent office (PCT) and national patent offices of other countries.
