Blog is not only a platform where you can share thoughts and ideas on any topic with your subscribers, but a blog can also be a source of stable income. Therefore, protecting its content is important for its future promotion in the market.
In November 2024, the Russian Federation adopted a law on registration of bloggers with an audience of over 10,000 people in the Roskomnadzor Register. If they do not register, bloggers may be limited in their activities (for example, they will be prohibited from accepting donations or placing advertisements). The law covers social networks (VKontakte, Odnoklassniki, TikTok, Likee, YouTube, Telegram, LiveJournal, Pikabu, Zen, Rutube, Twitch, Discord, etc.), personal blogs on websites and platforms, if the information published there is intended for the general public, as well as video hosting.
The purpose of the adopted law is to identify public authors and combat disinformation. At the same time, inclusion in the register will allow bloggers not only to increase the audience’s trust in them, which begins to perceive the blogger as an expert in a certain field, but also to expand opportunities for cooperation with advertisers and other interested parties who can invest money in the development of the blog, which in turn will become the basis for successful and long-term partnerships and will strengthen their own business.
It is important to protect the content of the content, since a blog is a complex entity that includes many intellectual property objects: databases, articles, audiovisual works, graphic images, photos, advertising, information about the blogger’s business, etc., the copyrights to which may belong to all their rights holders. It should be remembered that informational messages, works of folk art, objects of state and municipal symbols, official documents, etc. are not protected by copyright.
To prevent illegal use of content, for example, on social networks, a blogger can use the help of the support service by providing documents confirming authorship and the fact of violation (for example, a link to the primary publication or a certificate of deposit). In such cases, the post will be deleted, and the violator may be blocked.
On blog platforms, to prevent duplication of material from its rightful owner, installing special plugins that prohibit copying text, saving images or recording videos from pages will help. And VKontakte uses the “Nemesis” program, with which you can automatically detect duplicate publications and send them for review by moderators. You can also use the Anti-Piracy system.
Copyright extends to content created by the blogger himself, and no one has the right to use it without his consent. That is, in accordance with Art. 1255 of the Civil Code of the Russian Federation, a blogger has an exclusive right to all content created by him, as well as personal non-property rights that are inalienable and always assigned to him: the right to a name, the right to authorship, the right to inviolability, the right to publication. Without the consent of the author and payment of remuneration to him, you can quote his works for scientific, critical, informational or educational purposes in accordance with Art. 1274 of the Civil Code of the Russian Federation.
To mark protected material for the purpose of communicating it to the general public, a blogger may:
- put a copyright symbol - ©, which reminds users that all published materials are protected by copyright;
- Add watermarks to visual content indicating the name, title or address of the blog.
When a conflict of interest arises and the dispute is brought to court, evidence of authorship is usually required. Reliable evidence can be a certificate of deposit of the material on the n’RIS online service, where the blogger can place a file with data on authorship, date and time of uploading the material in a special storage box. At the end of the procedure, he is issued a certificate confirming copyright.
You can register a blogger's pseudonym, which will be linked to his first and last name, in the ISNI (International Standard Name Identifier) International Register. This register is used by publishers, bibliographic services, copyright and related rights management organizations, search engines, online stores and many others.
A pseudonym can also be protected by registering it with Rospatent as a trademark. It is important to take into account the content, quality of the blog content and articles posted in it. For example, if it contains advertising from partners about the goods they produce and sell or the services they provide, the blogger’s trademark must be registered under the International Classification of Goods and Services (ICGS) for class 35 of the ICLG (advertising; business management). And when educational services are provided by the blogger himself - for class 41 (education; training; entertainment).
A blogger can also obtain a patent for an invention if he independently developed and uses his own software to communicate with subscribers, partners and anyone interested in the blog, or, for example, to develop his business.
That is, the choice of ways to protect blog content depends on its content and purpose. In cases of its illegal use by an unscrupulous competitor, you can first contact the violator in a pre-trial manner, using support services or in person and refer to the original post, attaching a link as evidence.
As a rule, conflict situations are resolved pre-trial, but if efforts are unsuccessful, then you can go to court. Liability for copyright infringement is regulated by Article 1301 of the Civil Code of the Russian Federation, and for illegal use of a trademark - by Article 1515 of the Civil Code of the Russian Federation.
In conclusion, I would like to note that protecting blog content requires certain knowledge and therefore requires the involvement of lawyers and patent attorneys.
