About the client
Our client's competitor has registered a trademark in his name for an Indian cosmetics manufacturer.
The essence of the problem
The client’s product cards on the marketplace were blocked due to a claim from another Russian person who registered the trademark of the Indian company “Khadi” in his name. However, this designation is the logo of the Indian manufacturer, under which the products are sold throughout the world.
Uniqueness and complexity of the case
The difficulty was the need to select the most effective legal instruments in the conditions of heterogeneous judicial practice. As well as involving the original Indian manufacturer in the business.
Our solution
We proposed a comprehensive plan of action, including both an appeal to the Federal Antimonopoly Service, the Chamber of Patent Disputes, and the initiation of litigation.
Result
The dispute was resolved by concluding a settlement agreement, as a result of which the exclusive right to the trademark in Russia was transferred to its proper owner - the Indian manufacturer.
