About the client
A client approached us to register the “Ormadream” trademark.
The client of Spring Constructions LLC (Corretto brand), a manufacturer of furniture and mattresses, applied for registration of the Ormadream trademark.
The essence of the problem
During the examination, Rospatent discovered the similarity of the declared designation “Ormadream” with a series of registered trademarks “Ormatek”, which became the basis for a preliminary refusal of registration.
Uniqueness and complexity of the case
The difficulty was the need to overcome the examination’s conclusion, based on the opposition to the designation of several trademarks of the “Ormatek” series, which significantly increased the likelihood of refusal. However, we managed to challenge the department’s position, proving that there was no confusion between the designations.
Our solution
We prepared a reasoned response, challenging the expert’s arguments, including pointing out the lack of similarity in visual and phonetic assessment criteria.
Result
The examination found the arguments of our position convincing, and as a result, a decision was made to register the trademark “Ormadream” in relation to all declared goods.
