Employees of Vitalpharm CJSC contacted us with a request to represent their interests in the Chamber of Patent Disputes in order to invalidate the patent for an invention (patent No. RU2784978) by their competitor.
A preliminary study of the provided material and an assessment of the potential risks when filing an objection allowed us to come to the conclusion that it was possible to obtain a positive decision in the interests of our client, after which the lawyers of our company sent an objection against the grant of a patent for an invention to the Chamber of Patent Disputes.
After receiving feedback on our objection from the lawyer of the owner of the disputed patent, we prepared a reasoned response to the Chamber of Patent Disputes, which set out convincing justifications for our position.
At the last meeting, despite the expert’s criticism of our position, representatives of the Erfis company, after presenting convincing arguments supported by documents, received a positive decision to recognize the issued patent for an invention as invalid in full on the basis of the lack of novelty of the invention.
