The declared designation must be new, i.e. not have identical or confusingly similar trademarks in relation to homogeneous classes of the ICGS (link to the ICGS page).

Figurative, verbal, alphabetic, digital, three-dimensional and other designations or their combinations, which allow distinguishing the goods and services of some persons from similar goods or services of other persons, can be registered as a trademark.

The designation should not be: entered into general use to designate goods (services) of a certain type; which are generally accepted symbols and terms; indicating the type, quality, quantity, property, purpose, value of goods, as well as the place and time of their production or sale; representing international non-proprietary names of medicines; having a direct descriptive connection with the goods or services for which they are used;
Designations that reproduce state emblems, flags and emblems, abbreviated or full names of international organizations and their coats of arms, flags and emblems, official control, guarantee and assay marks, seals, Olympic symbols, awards and other insignia, as well as designations confusingly similar to them, are not registered as trademarks.

To apply you will need:

  • enter into an agreement to file a trademark in the Republic of Kazakhstan;
  • designation in good quality jpg format;
  • details of the applicant (name, TIN, address - for a legal entity; full name, TIN, address - for an individual).

What is an application and how is it submitted?

The application and the documents attached to it are submitted to the Republican State Enterprise “National Institute of Intellectual Property” (hereinafter referred to as RSE “NIIS”) using the official website of the RSE “NIIS” www.qazpatent.kz. in the form of an electronic document through your Personal Account.

Conducting business on an application for registration of a trademark with the RSE “NIIS” can be carried out with the applicant or through a patent attorney, as well as through another representative.

The powers of a patent attorney or representative are certified by a power of attorney issued to him by the applicant.

What is the fee for filing a trademark?

The amount of the fee depends on the applicant. The fees are different for legal entities and individuals.

For example, if a trademark is filed by an individual in one class of the ICGS, then the fee will be:

  • 63,700 tenge for filing an application and conducting an examination;
  • 36,544.48 tenge for registration of a trademark and issuance of a certificate.
  • The fee is paid in rubles at the exchange rate on the day of payment.

What are the stages of registering a trademark in Kazakhstan?

Two stages can be distinguished.

First stage – formal (preliminary) examination of the trademark. The deadline is 1 month from the date of receipt of the application. At this stage, the content of the application and the availability of necessary documents are checked. Based on the results of the preliminary examination, a notification is sent about the acceptance of the application for registration of a trademark for consideration.

Second stage - substantive examination. The duration is on average 7 months from the date of application. At this stage, the compliance of the applied designation with the requirements established by Articles 6 and 7 of the Law “On Trademarks, Service Marks and Appellations of Origin of Goods” is checked.
