The validity of a trademark is calculated from the date of its priority (usually from the date of filing the application). Renewal of a trademark (extension of the validity period of the exclusive right to a trademark) is carried out every 10 years, an unlimited number of times.
Renewal of a trademark can be carried out at the request of the Copyright Holder if it is filed during the last year of validity of the trademark registration. That is, starting from the 9th year to the 10th year, from the 19th year to the 20th year and so on.
The application is submitted in the prescribed form in Russian and is considered within two months from the date of its receipt by the Patent Office.
With the application, the Copyright Holder sends a payment order for payment of the fee for the renewal of the exclusive right to the trademark and a power of attorney for the representative, if acting through a patent attorney.
If the documents are incorrectly executed, then Rospatent sends a request to the Copyright Holder, who must, within two months from the date of sending the request by Rospatent, submit the necessary documents and/or make the required changes to them.
If the Copyright Holder did not have time to submit an application, he may be given a six-month period to submit it after paying an additional fee and completing the application.
After reviewing correctly executed and timely submitted documents on the extension of the exclusive right to a trademark, Rospatent makes an entry in the Register of Trademarks, and the applicant is sent an Appendix to the trademark on the extension of its validity.
For example, if the filing date (priority date) of a trademark was July 24, 2018, then you can submit documents to extend the exclusive right to a trademark from July 24, 2027 to July 24, 2028.
If an application to extend the exclusive right to a trademark was not filed on time, then until January 24, 2029, you can file a petition for an additional six-month period to extend the validity of the trademark.
