Question and answer
What is an invention and why patent it?
An invention is a solution aimed at achieving a certain technical result in a particular field. These could be devices, new substances, methods of their production/use.
Patenting an invention solves several problems. So, for example, having received a patent for an invention, you can become a monopolist in the market with a particular product, or you can enter into a licensing agreement with an interested party. You can also sell your exclusive rights to the invention or use it as collateral in a bank when receiving funds.
What is the difference between an invention and a utility model?
The main differences include patenting criteria. So, for an invention there are three of them: “inventive step”, “novelty”, “industrial applicability”. For a utility model, “novelty”, “industrial applicability”.
“Inventive step” is the non-obviousness of your solution to a specialist in this field of technology.
Other differences include the duration of patents.
Inventions – 20 years. Utility models – 10 years.
Inventions related to medicines, pesticides and agrochemicals can be extended for an additional period, but not more than 5 years.
